Toyota fuel pump settlement from class-action lawsuit

Toyota Fuel Pump Settlement Details

Posted on by

Toyota has taken steps towards resolving a class action lawsuit involving a fuel pump. This was confirmed through recent filings in the United States District Court of the Eastern District of New York.

A joint motion has been filed by the defendants, including Toyota Motor North America, Inc., Toyota Motor Corporation, and Denso International America, Inc., and the plaintiffs representing the class. The motion requests that the court approve the proposed settlement and dismiss any objections to it.

The legal complaint, submitted in the beginning of 2020, referenced a safety recall document regarding Toyota cars equipped with faulty low-pressure Denso fuel pumps. It alleged violations of New York business laws and breach of warranty.

In September 2022, the U.S. District Court for the Eastern District of New York granted initial approval for the settlement. The proposed order, submitted by both parties in a joint motion for final settlement approval in November, outlines a nationwide settlement class that specifically pertains to cars equipped with specific Denso low-pressure fuel pumps.

This class also encompasses a selection of vehicles that were previously recalled by Toyota. It is reported that the class includes individuals who currently or previously owned or leased over 4.9 million Toyota and Lexus vehicles.

The measures for relief in the settlement consist of a program for customer support lasting 15 years, an extended warranty for new parts, a program for loaners/towing, and reimbursement for out-of-pocket claims. These measures are dependent on the type of vehicle involved in the settlement.

The legal matter in question is the case of Sharon Cheng and others against Toyota Motor Corporation, with case number 1:20-cv-00629-WFK-JRC, being heard in the United States District Court for the Eastern District of New York.
